FluxxGolf (“we,” “us,” or “our”) is the data controller for fluxxgolf.com. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you browse our site, sign up for email updates, complete our product survey, or request founder pricing.

By using the site or submitting your email, you agree to this policy. If you sign up for email updates, you also consent to receive marketing communications related to the path you chose. You may withdraw that consent at any time by unsubscribing. If you do not agree, please do not use the site or submit personal information.

Information you provide. When you sign up, we collect your email address and which signup path you chose (founder pricing or journey updates). Both paths include a short survey that collects your setup preference, product priority, and how important solving low-light visibility is to you (rated 1–5). We may also record optional attribution data, such as which page or button you used to sign up. If you contact us directly, we keep the information you send so we can respond and maintain support records.

Information collected automatically. When you visit fluxxgolf.com, we and our analytics providers may collect pages viewed, clicks and interactions, referring URLs, browser and device type, operating system, and approximate location derived from your IP address. We use PostHog to capture custom events (such as when you open founder pricing, complete signup, or finish the survey), error and exception data, and session replay data (such as scrolling and on-page interactions) when replay is enabled. Vercel Analytics provides aggregated page-view metrics. When you submit a signup or survey form, we temporarily use your IP address to prevent abuse through rate limiting.

What we do not collect. We do not knowingly collect payment card information, government identifiers, precise geolocation, health information, or other sensitive personal information through fluxxgolf.com. Our site is not directed to children.

Deliver product updates, launch communications, and founder pricing messages for the path you selected.

Understand demand, improve our product, and shape launch pricing and offers based on aggregate survey responses.

Prevent abuse and protect the security of our signup and survey forms.

Comply with law, enforce our terms, and protect our rights and users.

We do not sell your personal information. We do not share personal information for cross-context behavioral advertising as defined under the CPRA.

If you are in the European Economic Area or the United Kingdom, we process personal information on the following legal bases:

Performance of a request or steps at your request — to process your signup, deliver survey confirmations, and send your founder discount code when applicable.

Consent — to send you marketing emails related to the signup path you chose. You may withdraw consent at any time by unsubscribing.

Legitimate interests — to understand product demand, analyze and improve our site, prevent abuse, and maintain security. You may object to processing based on legitimate interests by contacting us.

Legal obligation — where we must retain or disclose information to comply with applicable law.

Get Founder Pricing. Enter your email, complete the three-question survey, and receive the receive a founder discount code (25% off a future qualifying purchase at launch) by email, plus founder-related launch communications.

Follow the Journey. Enter your email from the footer signup, complete the same three-question survey, and receive build and launch updates. You do not receive a founder discount code through this path.

Both paths may receive product-update emails. Journey signups do not receive founder pricing offers unless they separately complete the founder pricing flow. You can unsubscribe from marketing emails at any time — see Your Rights below.

We use service providers that process information on our behalf. These include Resend (transactional email delivery, contact and audience storage, and email segments), PostHog (product analytics, session replay, and exception capture), and Vercel (website hosting and Vercel Analytics). Resend may store contact properties such as your signup flow, survey answers, signup source, and discount code status. These providers access information only to perform services for us and are contractually expected to protect it.

We may disclose information if required by law, to respond to lawful requests, to protect safety and rights, or in connection with a business transfer such as a merger or acquisition.

We do not share personal information with third parties for their independent marketing purposes.

Marketing emails include an unsubscribe link. You may also contact us to opt out.

Even after you unsubscribe, we may send transactional or service-related messages where permitted, such as confirmations tied to a request you made.

We use cookies and similar technologies (including local storage) for site functionality and analytics. PostHog uses first-party cookies and local storage to identify sessions and measure how visitors use fluxxgolf.com.

We do not use advertising or cross-site tracking cookies.

You can control cookies through your browser settings. PostHog also provides opt-out guidance in its privacy documentation. Disabling cookies may limit analytics but should not prevent you from signing up or completing the survey.

We retain signup and survey records for as long as needed to contact you about launch offers, honor founder pricing requests, provide support, meet legal obligations, and resolve disputes — typically up to 24 months after your last meaningful interaction, unless a longer period is required by law.

Analytics data is retained according to PostHog and Vercel default retention settings.

IP addresses used for rate limiting are held in short-lived in-memory buckets (minutes) and are not stored in our application database long term.

When information is no longer needed, we delete or anonymize it where reasonably possible.

All users. You may request access to, correction of, or deletion of your personal information by emailing contact@fluxxgolf.com with the subject line “Privacy Request.”

EEA & UK (GDPR). You may have the right to access, rectify, erase, restrict, or port your personal information, object to processing based on legitimate interests, withdraw consent where processing is based on consent, and lodge a complaint with your local data protection supervisory authority.

California (CCPA/CPRA). In the preceding 12 months, we have collected identifiers (such as email address and IP address), commercial information (such as survey preferences and signup flow), internet or other electronic network activity (such as pages viewed and interactions), and inferences drawn from the above (such as product interest). Sources include you directly and automatic collection through our site and service providers. We use this information for the purposes described in this policy. We disclose identifiers and commercial information to service providers (Resend, PostHog, and Vercel) as described above. We do not sell personal information and do not share it for cross-context behavioral advertising. California residents may request to know, delete, or correct personal information. Because we do not sell or share personal information, opt-out of sale/share and limit-use requests for sensitive personal information are not applicable — we do not collect sensitive personal information as defined by the CPRA. We will not discriminate against you for exercising privacy rights. To verify your request, we may ask you to respond from the email address associated with your signup. Authorized agents may submit requests with written authorization from you.

We use reasonable administrative, technical, and organizational measures designed to protect personal information. No method of transmission or storage is completely secure.

fluxxgolf.com is not directed to children under 13, and we do not knowingly collect personal information from children under 13. Contact us if you believe a child provided information and we will delete it. In some EU member states, parental consent may be required for information society services offered to children up to age 16.

If you access the site from outside the United States, your information may be processed in the United States and other countries where we or our service providers operate. For users in the EEA or UK, international transfers rely on appropriate safeguards, such as standard contractual clauses adopted by service providers where applicable.

We may update this policy from time to time. The version posted on fluxxgolf.com applies when you use the site. Material changes will be reflected in the last-updated date below.
